01Agreement and acceptance
These Terms and Conditions govern your access to and use of the Whole Person Conversations, LLC website and the services described here. By using this site, you agree to these terms. If you do not agree, do not use the site. Any separate written enrollment agreement also applies to the specific engagement it covers. If a term here conflicts with an enrollment agreement about that engagement, the enrollment agreement controls only for that engagement.
02Who may use this site
This site and its professional offerings are intended for adults who are working professionals. You must be at least 18 years old and able to enter a binding agreement to use the site or apply. The site is not directed to children.
03Applications, admission, and offerings
Available work includes application-only private coaching, team skill development and workshops, speaking, an on-demand resource library, and The Advisor Advantage, a 3-day immersive certification with continuing education hours. To seek enrollment, submit the online application, have a 20-minute first conversation, and wait for Melissa to review the application and decide whether to admit you. Applying or having a first conversation does not guarantee admission, a place in a cohort, or an engagement. The exact scope and conditions of an accepted engagement are provided in writing.
04Educational purpose and professional boundaries
The services and materials are educational and professional-development resources. They are not therapy, mental health care, legal advice, tax advice, investment advice, or financial advice, and do not create a clinician-client, attorney-client, or financial-advisor relationship. For further information, read the Disclaimer. Seek advice from an appropriately qualified professional for your circumstances.
05Fees and payment
Fees are not published on this site. Fees are provided to accepted applicants in writing before enrollment. Payment is by card through a third-party payment processor. You may pay in full or in installments as stated in your enrollment agreement. That agreement will state the applicable charges and payment schedule before you enroll. You are responsible for keeping payment details current and meeting the agreed payment schedule. A payment processor may apply its own terms and privacy practices.
06Refunds and cancellations
Refund and cancellation terms depend on the offering and the written enrollment terms that apply. For The Advisor Advantage, the specific cancellation and transfer terms are set out in the Refund and Cancellation Policy. Review that policy and your enrollment agreement before paying. Nothing here limits rights that applicable law does not allow to be limited.
07Intellectual property and marks
The site and its original text, frameworks, teaching materials, recordings, graphics, and other content are owned by Whole Person Conversations, LLC or used with permission and are protected by applicable intellectual-property laws. Listen Beyond Words™, HELD™, Dynamics of Change™, Where's Your Waterline?™, and Transition Clarity Loop™ are marks owned by Whole Person Conversations, LLC. No ownership is transferred to you.
08Permission to use materials
Subject to these terms, the applicable enrollment agreement, and the EULA, you may use materials made available to you only for your own permitted professional or business use during authorized access. Do not copy, alter, publish, publicly display, record, distribute, resell, sublicense, or make materials available to others unless Whole Person Conversations, LLC has given written permission or the law allows it.
09Acceptable use
Use the site lawfully and respectfully. Do not interfere with its operation or security, attempt unauthorized access, introduce malicious code, misrepresent your identity, scrape or harvest information without permission, infringe another person's rights, or use site content to create a competing or misleading product. Do not share access credentials or bypass access restrictions.
10Cohort discussions and confidentiality
Participants are expected to treat personal, client, firm, and business information shared in a cohort or group discussion as confidential, and not to disclose or use another participant's information outside the program without that person's permission. Do not share confidential client information in program discussions unless you are authorized to do so and have removed identifying details where appropriate. Group participation cannot guarantee that every participant will keep information confidential. Separate confidentiality obligations in an enrollment agreement remain in effect.
11Communications and consent
We may communicate with you about an application, enrollment, or requested service using the contact details you provide. Marketing email, SMS, and WhatsApp messages are sent only where the required permission has been separately requested and provided. Message permissions are not a condition of applying or purchasing. Message and data charges may apply. You may opt out of marketing texts by replying STOP and request help by replying HELP where supported; email opt-out instructions will be included in applicable marketing email. Read the SMS Terms and Privacy Policy for more information. You may contact [email protected].
12Information you submit
You are responsible for information and materials you submit through the site or in connection with an application. Do not submit information you are not authorized to share, sensitive client records, or content that violates another person's rights. You permit us to use information you submit as reasonably needed to respond to your request, evaluate an application, or provide the service you requested, subject to the Privacy Policy. This permission does not transfer ownership of your materials.
13Third-party links and services
The site may link to websites or services operated by others, including payment services. Those services are governed by their own terms and privacy practices. We do not control or endorse third-party content and are not responsible for its availability or practices. Your use of a third-party service is between you and that provider.
14Disclaimers of warranties
To the extent allowed by law, the site and its content are provided on an as-available basis, without warranties beyond those that applicable law requires. We do not warrant uninterrupted access, error-free content, or any particular professional, client, business, financial, or personal outcome. Nothing in these terms excludes a warranty or protection that cannot legally be excluded.
15Limitation of liability
To the extent allowed by law, Whole Person Conversations, LLC will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from use of the site or services. To the extent allowed by law, the total liability for a claim relating to the site will not exceed the amount you paid to Whole Person Conversations, LLC for the specific service giving rise to the claim during the 12 months before the event. These limits do not apply to liability that applicable law does not permit to be limited, including any nonwaivable statutory rights or liability for intentional misconduct where such limitation is prohibited.
16Your responsibility for claims
You agree to be responsible for third-party claims and reasonable costs to the extent they arise from your unlawful use of the site, your material breach of these terms, or your infringement of another person's rights. This does not require you to indemnify Whole Person Conversations, LLC for its own conduct, and does not apply where applicable law prohibits it.
17Term and termination
These terms apply while you use the site. We may suspend or end site access when reasonably necessary for security, legal compliance, or a material breach of these terms. Ending access does not cancel payment obligations or other terms that by their nature continue, including ownership, confidentiality, liability limits to the extent permitted by law, and dispute provisions. Any service-specific cancellation or access period is governed by the applicable enrollment agreement.
18Colorado law and venue
Colorado law governs these terms, without regard to conflict-of-law principles. Any dispute relating to these terms or the site must be brought in a state or federal court located in Colorado, and you and Whole Person Conversations, LLC consent to that venue and jurisdiction. No arbitration requirement is created by these terms. Nothing in this section waives a right that Colorado or other applicable law does not allow to be waived.
19Changes to these terms
We may revise these terms by posting an updated version on this page and changing the date below. Changes apply from the date posted and do not retroactively change an enrollment agreement unless that agreement allows it or you agree. Continued site use after an update means you accept the revised terms to the extent permitted by law.
20Severability and entire agreement
If a court finds a provision unenforceable, the remaining provisions remain in effect to the extent they can operate lawfully. These terms, together with any applicable enrollment agreement and the policies linked here, describe the agreement concerning this site. They do not replace a separate written agreement for a particular engagement.
